Refund Timeline Guide

How Long Does It Take to Get a GAP Insurance Refund? (Timelines by Provider and State)

Most GAP insurance refunds take 30 to 90 days from the date your written request is received. States with GAP refund statutes set firm legal deadlines: California (Civil Code § 2982.12) requires payment within 60 business days, Colorado (C.R.S. § 5-9.3-106) within 30 days, and Florida (Statutes § 520.07) gives you 90 days to submit your request. In states without a statutory deadline, providers set their own processing timeframes, which can stretch to 8 weeks or longer. Your provider, the completeness of your paperwork, and whether your state requires an automatic refund all affect the timeline.

Follow-up if late

If you haven't received anything, send a follow-up letter and consider filing a complaint.

What can slow your refund down

  • A missing payoff letter — providers need proof your loan ended.
  • The refund is routed through the dealer instead of directly to you.
  • The provider requires their own cancellation form, which you didn't include.
  • The refund is applied to your loan balance instead of mailed to you — this is common and easy to miss.

What to do if it's taking too long

If your refund is past 30 days with no word, take these steps:

  • 1.Put your request in writing if you haven't already. A written request creates a record that's hard to ignore.
  • 2.Keep dates — note when you sent the request, when you followed up, and who you spoke with.
  • 3.Follow up at 30 days. A second letter or call often gets things moving.
  • 4.If you're ignored, escalate to your state's consumer-protection or insurance department.

Several states set legal deadlines for how quickly refunds must be paid, and a well-cited written request is the strongest tool you have. Keep copies of everything you send.

Frequently asked questions

Does the refund come as a check?

Most GAP refunds are mailed as a paper check to the address on file with your provider. Some providers offer direct deposit if you have an account with them. If your loan is still active, the refund may be applied as a credit to your loan balance instead of being sent to you directly.

Can the dealer keep part of it?

The dealer typically does not keep part of your refund. GAP refunds are usually handled by the GAP administrator or your lender, not the dealership. However, if the dealer routed the refund through themselves, it can cause delays. Always request that the refund be sent directly to you.

Does it go to me or my lender?

It depends on whether your loan is still active. If your loan is paid off, the refund should come to you as a check or direct deposit. If your loan is still open, the provider may apply the refund as a credit to your loan balance, reducing what you owe. You can request a direct payment instead.
