1. Acceptance of Terms
By accessing and using GAPInsuranceRefunds.com (the "Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by these terms, please do not use this Service.
2. Nature of Service
Document-Preparation Service: GAPInsuranceRefunds.com is a document-preparation and claim-assistance service. We are not a law firm and do not provide legal advice. We do not provide financial, insurance, tax, or claims-adjusting advice. We are not affiliated with or endorsed by any GAP administrator, insurer, lender, dealer, government agency (including CFPB, FTC, BBB, USPS), or state regulator.
No Legal Representation: We are not a law firm, insurance agency, or licensed claims adjuster. We do not represent you in negotiations with GAP providers, lenders, dealers, or any third parties. All communications with providers are made on your behalf as your authorized representative for document submission purposes only.
No Refund Amount Guarantees: We do not guarantee any specific refund amount or outcome. Refund estimates are based on user-provided data and state laws; actual refunds are determined solely by GAP providers. Estimates are informational only and may differ significantly from actual refunds received.
The information, documents, and materials provided through this Service are for informational and educational purposes only. Nothing on this website constitutes legal, financial, insurance, or tax advice or creates an attorney-client, accountant-client, or other professional relationship. You should consult with a licensed attorney, accountant, or insurance professional in your jurisdiction for advice regarding your specific situation.
3. Service Fee Refund Guarantee (Not GAP Refund Guarantee)
Important: We are a document-preparation and claim-assistance service. We cannot guarantee that your GAP provider will approve your refund claim, as this depends on factors beyond our control including your GAP contract terms, state laws, provider policies, mileage, payoff date, cancellation reason, whether a benefit was already paid, and other individual circumstances. GAP providers make all final refund decisions. We cannot guarantee any refund, response, approval, timeline, or amount from your provider.
However, we do guarantee our service quality: If your GAP refund claim is formally denied by the provider or receives no response after our complete correspondence process, you are entitled to a full refund of your service fee. This guarantee is subject to the terms outlined in our 100% Refund Guarantee Policy, which requires that:
- We maintain direct communication with your GAP provider throughout the process
- We independently verify all outcomes before issuing refunds
- You provide accurate and complete information about your case
- You cooperate with our correspondence process and follow-up requirements
- You have not already received a GAP refund for the same claim
- Your claim is not fraudulent or misrepresentative of facts
Refund requests must be submitted within 30 days of purchase and require written attestation that you have not received a refund. We reserve the right to verify provider responses and may request additional documentation before processing refunds. We reserve the right to modify this guarantee policy at any time.
4. Accuracy of Information
You are responsible for ensuring the accuracy of the information you provide to this Service. Inaccurate information may result in incorrect refund estimates or delayed refund processing. We make no representations or warranties about the accuracy, completeness, or reliability of any information provided through this Service.
5. Document Generation and Upload Responsibilities
Documents generated by this Service are templates and sample letters for your convenience. You are responsible for reviewing, modifying, and ensuring the appropriateness of any documents before submitting them to third parties. We are not responsible for the outcome of any submissions made using documents generated by this Service.
Document Upload Restrictions: You should NOT upload Social Security Numbers (SSNs), full bank account numbers, tax documents, medical records, or unrelated sensitive information unless specifically required by your GAP provider. GAPInsuranceRefunds.com does not request full SSNs by default. If a provider requires identity verification, you should provide only the minimum required information, preferably last four digits or redacted documents where accepted.
User Responsibility: You are responsible for ensuring that uploaded documents are accurate, authorized, relevant to the claim, and do not contain unnecessary sensitive information. Before uploading, please redact full SSNs, unrelated account numbers, barcodes, QR codes, tax information, medical information, and unrelated personal data unless your provider specifically requires it.
Provider Submission Authorization: When you authorize us to send documents to a GAP provider, administrator, lender, dealer, or other third party, you understand that the recipient will receive the information included in your claim documents. Please review all documents before submission. Provider contact information is matched from our provider directory where available. You must review and confirm the recipient email address and mailing address before submission. We are not responsible for incorrect or outdated provider contact information if you confirm submission after review, except where prohibited by law.
6. User Responsibilities and Authorized Submissions
You agree to: (a) provide accurate, complete, and truthful information; (b) use the Service only for lawful purposes; (c) not misuse or attempt to interfere with the Service; (d) not use the Service to send fraudulent, false, or misleading communications; (e) comply with all applicable laws and regulations; (f) submit refund requests only on your own behalf or with proper legal authorization; and (g) not submit false, fraudulent, or unauthorized claims.
You are solely responsible for ensuring all information you provide is accurate and that you have legal authority to submit refund requests for the vehicle, loan, and GAP contract in question. Providing false information, forging signatures, or submitting fraudulent claims may result in civil and criminal liability. We reserve the right to terminate accounts and refuse service to users who violate these terms.
7. Third-Party Services and Provider Directory
This Service may contain links to third-party websites or services (including GAP providers, lenders, dealers, and regulatory agencies). We do not control and are not responsible for the content, accuracy, or practices of these third-party sites. You access them at your own risk.
Provider Directory: Our provider directory contains contact information (email addresses, mailing addresses, phone numbers, document requirements) compiled from publicly available sources. This information may not be current, accurate, or complete. Provider contact details may change without notice. You should verify all provider information independently before submitting documents. We are not responsible for errors, omissions, outdated information, or provider non-response resulting from use of our directory.
8. Disclaimer of Warranties and Security Limitations
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. Website errors, outages, delays, inaccurate inputs, third-party failures, provider-directory errors, mail delays, email delivery failures, and technical problems may occur.
Security Safeguards: We use reasonable administrative, technical, and organizational safeguards to protect user information. However, no internet-based service, email transmission, file-storage system, or third-party delivery process can be guaranteed to be completely secure. You acknowledge this risk and agree to take precautions on your part, including redacting unnecessary sensitive information before upload.
Third-Party Processing: Certain information may be processed by trusted service providers, including hosting, database, payment, email, certified-mail, document-generation, support, and analytics providers. We require these providers to process information only as needed to provide the service and maintain confidentiality obligations.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID TO USE THE SERVICE (IF ANY). IN NO EVENT SHALL GAPINSURANCEREFUNDS.COM BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR DATA USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER SUCH LIABILITY ARISES FROM ANY CLAIM BASED UPON CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Some states do not allow limitations on implied warranties or the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you.
10. Indemnification
You agree to indemnify, defend, and hold harmless GAPInsuranceRefunds.com, its owners, operators, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees and costs) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your submission of false, inaccurate, or unauthorized information; (d) your submission of fraudulent or misleading communications to any third party; (e) provider complaints or disputes caused by your actions or information you provided; (f) your violation of any rights of another; or (g) your misuse of the Service.
11. Changes to Terms
We reserve the right to modify these Terms at any time. Continued use of the Service after any changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically for updates.
12. Termination
We reserve the right to terminate or suspend your access to the Service at any time, for any reason, without notice. Upon termination, your right to use the Service will immediately cease.
13. Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS TO SUE US IN COURT.
13.1 Agreement to Arbitrate: Any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or your use of the Service (including any alleged breach of these Terms) shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in the county where you reside, or if unavailable, in Los Angeles County, California.
13.2 No Class Actions: YOU AGREE TO RESOLVE ANY DISPUTE ON AN INDIVIDUAL BASIS ONLY. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT, CLASS-WIDE ARBITRATION, OR ANY OTHER REPRESENTATIVE OR CONSOLIDATED PROCEEDING. The arbitrator may not consolidate more than one person's claims or otherwise preside over any form of a representative or class proceeding.
13.3 No Right to Sue in Court: BY AGREEING TO ARBITRATION, YOU WAIVE YOUR RIGHT TO SUE US IN COURT. YOU ALSO WAIVE ANY RIGHT TO A TRIAL BY JUDGE OR JURY. All claims must be brought in the individual capacity only, and not as a plaintiff or class member in any purported class or representative proceeding.
13.4 Small Claims Exception: Notwithstanding the above, either party may bring an individual action in small claims court if the dispute qualifies for small claims court jurisdiction and the party agrees to participate only on an individual basis.
13.5 Arbitration Opt-Out: You may opt out of this arbitration agreement within 30 days of first using the Service by sending an email to legal@gapinsurancerefunds.com with the subject line "Arbitration Opt-Out" and your full name. If you opt out, you will be bound by all other terms of this agreement, but disputes will be resolved in court rather than arbitration.
13.6 Severability: If any portion of this arbitration agreement is found to be unenforceable, the remainder shall remain in full force and effect.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California and the United States, without regard to its conflict of law provisions. Subject to the arbitration agreement above, any disputes arising from these Terms or the Service shall be resolved in the federal or state courts located in Los Angeles County, California.
15. Electronic Communications
By using this Service, you consent to receiving electronic communications from us regarding your cases, service updates, and important notices. All notices, agreements, and disclosures we provide electronically satisfy any legal requirement that such communications be in writing.
16. Privacy and Data Protection
Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy. By using this Service, you consent to the collection and use of your information as outlined in the Privacy Policy. We implement industry-standard security measures to protect your data, but no method of transmission over the internet is 100% secure.
17. Complaint Resolution
We have a formal complaint resolution process to address any concerns about our service. If you have a complaint, please email support@gapinsurancerefunds.com. 18. Consumer Rights Notice
Nothing in these Terms limits your rights under applicable consumer protection laws, including the right to file complaints with regulatory agencies. You maintain all rights granted to you by federal and state law, including rights under the Consumer Financial Protection Act and your state's consumer protection statutes.
